These terms are an agreement between you and the company that operates Nine Pearls ("we", "us") for your use of Nine Pearls, including the website and the web app (together, "Nine Pearls"). By buying or using Nine Pearls you agree to these terms. If you do not agree, please do not use it.

1. Who can use Nine Pearls

Nine Pearls is offered to customers in the United States. You must be at least 18 years old and able to form a binding contract. You are responsible for keeping your password private and for everything that happens under your account.

2. Your purchase and license

Nine Pearls is sold as a one-time purchase. When you pay, we give you a personal, non-exclusive, non-transferable license to use Nine Pearls for your own personal use. You may not resell, share, or sublicense your account.

"Lifetime access" means access for as long as we operate Nine Pearls. It does not mean your lifetime or ours. If we ever decide to shut Nine Pearls down, we will give you at least 60 days' notice by email and a way to download your data.

Prices are shown in US dollars and may change for future buyers. Founding prices apply only to the number of members stated on the sales page.

3. Refunds

If Nine Pearls is not for you, email us within 14 days of your purchase for a full refund. See our Refund Policy. When a purchase is refunded, access to the account ends.

4. Your content

Everything you write in Nine Pearls, such as your lives, rituals, tasks and reflections, belongs to you. You give us only the limited permission we need to store it, display it to you and keep it backed up so the service works. We do not sell it and we do not use it for advertising. You can download or delete it at any time from inside the app.

5. Acceptable use

Please do not misuse Nine Pearls. That includes trying to access another person's account or data, attacking or overloading the service, reverse engineering it to copy it, using automated tools to scrape it, or using it for anything unlawful.

6. Not professional advice

Nine Pearls is a personal organization and reflection tool. It is not medical, mental health, legal or financial advice, and it is not a substitute for a qualified professional. If you are struggling, please reach out to a licensed professional or, in an emergency, call 911 or 988 in the United States.

7. Our property

Nine Pearls, including its name, design, text, graphics and software, belongs to us and is protected by law. These terms do not give you any rights to our trademarks or branding.

8. Availability and changes

We work to keep Nine Pearls available and your data safe, but we cannot promise it will always be uninterrupted or error-free. We may improve, change or remove features over time.

9. Disclaimers

To the fullest extent the law allows, Nine Pearls is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill. Our total liability for any claim relating to Nine Pearls is limited to the amount you paid us for it.

11. Indemnity

If you break these terms or the law while using Nine Pearls, you agree to cover the reasonable costs and claims that result against us.

12. Ending your account

You can delete your account at any time from inside the app. We may suspend or end an account that breaks these terms, after notice where reasonable.

13. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Florida, unless the law where you live requires otherwise.

14. Changes to these terms

We may update these terms. If a change is significant, we will tell you by email or in the app before it takes effect. Continuing to use Nine Pearls after that means you accept the new terms.
